Covid-19 Message to Members:

On March 9, 2020, Ohio Governor Mike Dewine issued Executive order 2020-OID  and declared a state of emergency in response to COVID-19. On March 11, 2020, the World health Organization publicly characterized COVID-19 as a global  “pandemic” requiring “urgent and aggressive action” to control the spread of COVID-19.  On March 13, 2020, President Donald J. Trump declared that the COVID-19 outbreak in the United States was a national emergency.  The Centers for Disease Control and Prevention (CDC) is directing that Americans must practice “social distancing.” On March 27, 2020, the Supreme Court of Ohio noted that “social distancing must be observed during the emergency period in all court proceedings and in each court to mitigate the spread of COVID-19.”

To date, the exponential spread of the Coronavirus Disease 2019 (COVID-19) has resulted in more than 330 confirmed cases and countless unconfirmed cases of COVID-19 throughout Mahoning County, and the highest number of deaths from COVID-19 of any of Ohio’s 88 counties.  While it would be irresponsible of the courts of this County to be closed for what the Supreme Court of Ohio has defined as an essential matter, the Mahoning County Bar Association Board of Trustees believes it would likewise be irresponsible for the courts to hold in-person hearings in non-essential matters, for doing so unnecessarily risks the health and life of litigants, attorneys, judges, court staff, security personnel and witnesses.

Therefore, the Mahoning County Bar Association Board of Trustees strongly urges all courts in this County to hold in-person hearings only when mandatory or in essential proceedings, those in which relief is necessary to protect a person’s immediate health, safety, or housing, or to prevent some other imminent, serious harm.  We recommend all other non-essential hearings and/or proceedings be held as telephone or video conferences, or sua sponte continued and rescheduled.  We do not issue this recommendation lightly, but in an effort to save lives.

Further, in an effort to keep members updated on the frequent changes as well as provide informational resources, the Mahoning County Bar Association’s website now includes a special COVID-19 page.  Please review the same for further notices and announcements.
